General Terms and Conditions

1. Scope of Application

These General Terms and Conditions apply to all orders placed via our online shop.

Consumers: natural persons who enter into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
Entrepreneurs: natural or legal persons who enter into a legal transaction in the course of their trade, business, or profession.

For entrepreneurs: Conflicting or supplementary terms and conditions do not become part of the contract unless we expressly agree to them.

 

2. Contracting Party, Conclusion of Contract, Correction Options

The purchase contract is concluded with Tom Nörenberg.

Products in the shop are initially non-binding offers. A contract is formed by clicking the order button. You will receive a confirmation via email immediately after submitting your order.

 

3. Contract Language, Storage of Contract Text

Contract language: German
The contract text and General Terms and Conditions are stored and sent to you via email.


4. Delivery Conditions

Shipping costs are charged in addition to the product prices.
Delivery is made via shipping only; self-pickup is not possible.


5. Payment

Payment methods: Credit card, PayPal, PayPal Express, Sofort/Klarna, Google Pay, giropay/paydirekt, Amazon Pay, Klarna (invoice, direct debit).

SEPA Direct Debit: Debit occurs within 10–15 days of contract conclusion. Pre-notification is provided 5 days in advance. The customer bears any fees for returned direct debits.
Klarna: Invoice ("Pay Later") or instant transfer ("Pay Now") subject to Klarna's terms and conditions.
PayPal: Payment processing via PayPal (Europe) S.à.r.l. et Cie, S.C.A.

The debit occurs immediately after the order is placed, unless otherwise stated.

6. Right of Withdrawal

Consumers have a statutory right of withdrawal. Details regarding the procedure, timeframes, and return shipping costs are outlined on our refund/cancellation page.

Note: There is no right of withdrawal for personalized products tailored to individual specifications (Section 312g para. 2 of the German Civil Code [BGB]).

7. Retention of Title

The goods remain the property of Tom Nörenberg until full payment has been made.

For business customers:

Ownership is retained until all claims arising from the ongoing business relationship have been settled in full.
Resale of the goods subject to retention of title is permitted; you hereby assign to us any claims arising from such resale, and we accept the assignment.
In the event of combination or mixing with other goods, we acquire co-ownership in proportion to the invoice value.
Collateral will be released upon request insofar as its value exceeds the claims by more than 10%.


8. Transport Damage

Consumers: Report damage immediately to the delivery agent and to us.
Business customers: Risk passes to the buyer upon handover to the freight forwarder/carrier.


9. Warranty and Guarantees

Statutory rights regarding defects apply.
Consumers: Please inspect goods immediately upon delivery and report any defects. Failure to report defects does not affect statutory claims.
Business customers:
Quality: Only our specifications and the manufacturer's description are deemed agreed upon.
Remedial action (repair or replacement) is at our discretion. In the event of two failed attempts: price reduction or withdrawal from the contract.
Warranty period: 1 year, excluding statutory special cases (injury to life, body, or health; fraudulently concealed defects; guarantees).


10. Liability

Unlimited liability for injury to life, body, or health, for willful misconduct or gross negligence, and for assumed guarantees.
In cases of simple negligence, liability is limited to foreseeable, typical damage.
Liability is otherwise excluded.

11. Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before consumer arbitration bodies.

12. Final Provisions


German law applies; the UN Sales Convention (CISG) is excluded.
Place of jurisdiction: Tom Nörenberg’s place of business for all disputes involving merchants, legal entities under public law, or special funds under public law.
